Description

TPWD MISSION

To manage and conserve the natural and cultural resources of Texas and to provide hunting, fishing and outdoor recreation opportunities for the use and enjoyment of present and future generations.

GENERAL DESCRIPTION

Under the direction of the Legal Division Director, this position performs moderately complex (journey-level) legal assistant work involving researching, analyzing, investigating, and drafting legal documents, and assisting attorneys with case management. Helps respond to public information requests, including review for exceptions to disclosure, preparation of correspondence with the Office of the Attorney General, and redaction of confidential information. Drafts and prepares pleadings, motions, briefs, discovery requests and responses, abstracts, petitions, summary judgments, legal correspondence, and other legal documents. Researches and analyzes sources such as statutes, case law, administrative records, opinions, articles, treatises, property titles, and rules and regulations. Checks citations, quotations, footnotes, and references for accuracy. Summarizes court opinions, laws, rules, and regulations. Files documents with the State Office of Administrative Hearings. Schedules, attends, and prepares attorneys for hearings, trials, meetings, interviews, appellate arguments, depositions, and docket calls. Assists in training others regarding public information requests. Performs related work as assigned. Works under general supervision, with limited latitude for the use of initiative and independent judgment. Complies with all Agency, Division and Branch rules, regulations, and procedures.


Qualifications:

MINIMUM QUALIFICATIONS:

Education:

Graduation from High School or GED.

Experience:

Three years of experience as a paralegal or legal assistant.

ACCEPTABLE SUBSTITUTIONS:

Education:

Thirty semester hours from an accredited college or university with coursework in law, public or business administration, or closely related field may substitute for one year of the required experience located under the minimum qualifications.

Experience:

Paralegal Certification from the Texas Board of Legal Specialization, National Association of Legal Assistants, National Federation of Paralegal Associations, or National Association for Legal Support Professionals may substitute for the required experience located under the minimum qualifications.

PREFERRED QUALIFICATIONS:

Education:

Graduation from an accredited college or university with Associate's degree and coursework in law, public or business administration, or closely related field.

Graduation from an accredited college or university with a Bachelor's degree and coursework in law, public or business administration, or closely related field.

Experience:

Experience working for a Texas state agency.

Experience processing requests for public information/open records under the Texas Public Information Act or the Freedom of Information Act.

Experience using GovQA.

Licensure:

Paralegal Certification from the Texas Board of Legal Specialization, National Association of Legal Assistants, National Federation of Paralegal Associations, or National Association for Legal Support Professionals.

KNOWLEDGE, SKILLS, AND ABILITIES

Knowledge of legal terminology;

Knowledge of state and federal laws, rules, and regulations;

Knowledge of research methods and techniques;

Knowledge of administrative and court procedures;

Knowledge of the legislative process;

Knowledge of public notice requirements; and

Knowledge of laws, rules, and procedures relating to the Texas Public Information Act.

Skill in using MS Word, Excel and Outlook;

Skill in using software for redaction of documents;

Skill in organizing information and tracking deadlines;

Ability to evaluate and relate findings to cases in question;

Ability to conduct investigations;

Ability to communicate effectively;

Ability to maintain confidentiality; and

Ability to conduct work activities in accordance with TPWD safety program.

WORKING CONDITIONS

Required to work from 8:00 a.m. to 5:00 p.m., Monday through Friday/alternative work schedule may be available;

Required to work overtime as necessary;

May be required to travel 5%;

Non-smoking environment in State buildings and vehicles.
